Update from Wednesday 16 February:
The case is being delayed presently by what appears to be undue and unnecessary procedures, even though the Court has agreed the matter is urgent and properly in the Expedition List of the Court. It was observed that despite Her Honour Justice Melissa Perry acknowledging the case is urgent, Her Honour refrained from discussing the reason for the urgency ie. children are dying and being injured. Otherwise the Court needs to confirm AVN’s standing to bring the case to court. Once the AVN shortly satisfies the Court that standing is not an issue, the AVN said that it will then aim for an urgent injunction to stop 5 -11 year old’s receiving the vaccine, while the case goes through these Court requested preliminary procedures and up to the substantive trial/hearing dates of the matter. Hopefully this injunction will be granted, so saving many children while the wheels of Justice creep along to a decision.
